The Platform provides access to AI-powered conversational companions and related features. The Services may include both free and Paid Services.
The Company may modify, suspend, or discontinue any part of the Services at its sole discretion and without prior notice.
The Services are provided for entertainment and informational purposes only.
The Services provide access to artificial intelligence–generated content, including AI-powered conversational companions ("AI Companions"). AI Companions are fictional automated systems and do not possess consciousness, emotions, intent, or real-world agency.
Interactions with AI Companions are generated algorithmically and are provided for entertainment purposes only. The Services are not intended to replace human relationships, professional advice, or real-world interactions.
You acknowledge and agree that:
You are solely responsible for your interpretation and use of any output generated by the Services.
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
You agree to provide accurate and complete information when creating an account.
The Company reserves the right to suspend or terminate accounts that violate these Terms, including in cases of fraudulent activity, abuse, misuse of the Services, or unauthorized payment activity.
You agree not to use the Platform for unlawful, abusive, harmful, fraudulent, or exploitative purposes. Prohibited conduct includes, but is not limited to:
All software, technology, trademarks, content, design elements, and algorithms associated with the Platform are the exclusive property of the Company or its licensors.
No ownership rights are transferred to you under these Terms.
Any AI Companions or content created or customized through the Platform remain the exclusive property of the Company.
Users are granted a limited, non-exclusive, non-transferable, revocable, non-commercial license to use such content solely within the Platform.
No commercial rights are granted.
Certain features of the Platform are available only through Paid Services.
Access to Paid Services becomes effective upon successful payment.
You are responsible for all applicable fees, charges, and taxes.
The Company is not liable for issues arising from unauthorized third-party payment platforms.
Free access to the Platform is subject to usage limits determined by the Company.
Subscriptions renew automatically at the end of each Billing Period unless cancelled prior to renewal.
Payment is processed automatically at the start of each renewed Billing Period.
A Subscription includes unlimited messaging access and a monthly allocation of Tokens, as disclosed at checkout.
Tokens:
You may cancel your Subscription at any time via your account settings.
Cancellation takes effect at the end of the current Billing Period.
Upon expiration or cancellation of Paid Services:
If a Subscription or Token purchase is refunded, it is deemed cancelled immediately.
Access to Paid Services and remaining Tokens will be revoked at the time of refund processing.
You agree to contact the Company to resolve any billing dispute before initiating a chargeback.
Initiating a chargeback may result in immediate suspension or termination of your account.
Any chargeback will result in immediate cancellation of the associated Paid Services and revocation of remaining Tokens.
The Company reserves the right to contest abusive or fraudulent chargebacks.
Additional statutory rights may apply for users residing in the EU or UK.
The Company reserves the right to deny refund requests in cases of abuse, repeated refund activity, or suspected fraud. Abuse includes:
The Company may suspend or terminate accounts engaged in such conduct.
The Company may remove or restrict content that violates these Terms or applicable laws.
The Company may suspend or terminate access to the Platform at its discretion for violations of these Terms.
The Platform is provided "as is" and "as available," without warranties of any kind.
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, or consequential damages.
You agree to indemnify and hold harmless the Company from claims arising from your use of the Platform or violation of these Terms.
These Terms are governed by the laws of Switzerland.
Any dispute shall be subject to the exclusive jurisdiction of the courts of Lausanne, Switzerland.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Provisions relating to payments, liability, intellectual property, dispute resolution, and indemnification shall survive termination.
The Company may update these Terms at any time.
Continued use of the Platform constitutes acceptance of the revised Terms.
